Seeing an increase in number of fraudulent marriages of Indian
women with Non Resident Indians (NRIs), the parliamentary committee
has come up with a decision to make ‘registration of NRI marriages’
compulsory.
Strict actions will be taken against corrupt protectorate of emigrants
offices (PoE) and fraudulent marriage bureaus, says the Standing
Committee on External Affairs.
The committee has also taken up the modernization of PoE effects,
introduction of smart cards, and revision of the rules listed
in the Emigration Act for increasing punishment against fraud
recruiting agents.
The government has been asked to take moves in favor of signing
of bilateral agreements with the countries including Kuwait, Oman,
Qatar and Malaysia, where million of working NRIs face exploitation.
The amendment will provide that divorce proceedings can be instituted
only in courts in whose jurisdiction the marriage was solemnized
or registered.
The committee has also suggested the complete amendment of the
Indian Marriages Act, which must say to take up the divorce proceedings
only in courts in whose jurisdiction the marriage was solemnized.
Also, the prospective bridegroom must submit an affidavit mentioning
the prior marital status and that affidavit must be notarised
by the respective embassy.
The committee expressed concern over the fact that Indian workers
abroad were facing numerous problems like non-payment or delayed
payment of wages, unilateral changes in the contract of workers
and changing the jobs arbitrarily.
Expressing the concern over bad plight of NRI workers, the committee
hjas asked the government to work in direction of protecting the
rights of Indian workers abroad, by entering into bilateral agreement
with countries which include considerable NRI populace.
